DC rezoning approved for Malloy Drainage

Unused land from the Malloy Drainage Project has been rezoned to Direct Control.
A public hearing for the rezoning bylaw was held during Coaldale town council’s regular July 10 meeting.
LUB Rezoning Bylaw 874-P-06-23 concerns a portion of land that was purchased by the Town in order to construct the south portion of Phase 2(a) of the Malloy Drain stormwater holding project. As part of the sale of the portion of land, the Town had agreed to sell back the unused portions of the land to the former owner once the project was completed.
According to the subdivision approval, one condition to resell those unused lands back to the former owner was that the lands in question were to be reincorporated back into the adjacent piece to the west, rather than creating a stand-alone title, as the creation of a new acreage space would not be in line with the expected urban style development of the area.
However, the former landowner would prefer not to incorporate the lands into the remainder of the quarter section, as there have since been changes in ownership.
“Due to changes in land ownership, the applicant has requested that the subdivided parcel not be consolidated,” said Hailey Winder, senior planner for the Town during the public hearing. “In order to accommodate this request, and ensure the lands remain available for future development, administration has proposed that the lands be redesignated to Direct Control.”
A Direct Control (DC) zoning district requires council approval before development can take place on that land. Rezoning the parcel to this district would solve the resulting planning challenge and ensure that no construction is approved for the site until the lands are further subdivided in line with an approved Area Structure Plan.
First reading of the bylaw took place during council’s regular June 26 meeting. At the time of the public hearing, no comments or feedback were received by the town. No one spoke for or against the bylaw during the public hearing.
Following the public hearing, council performed second and third and final reading of the bylaw.
